DM2 MixPad End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User", "you", or "your") and DM2 MixPad ("Company", "we", "us", or "our") governing your use of the DM2 MixPad software application and related services (collectively, the "Software").
By downloading, installing, accessing, or using DM2 MixPad, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not install or use the Software.
1. License Grant
Subject to your compliance with this Agreement, DM2 MixPad grants you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use the Software on compatible Apple devices that you own or control.
This license is provided solely for personal, educational, commercial, creative, and entertainment purposes in accordance with applicable law.
2. Restrictions
You agree that you will not:
- Copy, modify, distribute, or create derivative works of the Software
- Reverse engineer, decompile, or attempt to extract source code from the Software except where permitted by law
- Remove or alter copyright notices or branding
- Use the Software for unlawful purposes
- Attempt to bypass licensing, security, or hardware limitations
- Resell, rent, lease, sublicense, or redistribute the Software without written permission
3. Ownership
DM2 MixPad and all related content, including software, graphics, user interfaces, audio systems, trademarks, logos, and documentation, are owned by DM2 MixPad and protected by copyright, trademark, and other intellectual property laws.
This Agreement grants you a license to use the Software and does not transfer ownership rights to you.
4. User Content
You retain ownership of any audio files, music, loops, samples, recordings, or other content that you import into or create using DM2 MixPad.
You are solely responsible for ensuring that you have the necessary rights, licenses, and permissions to use any imported or recorded content.
DM2 MixPad does not claim ownership over your music or creative works.
5. Hardware and System Requirements
DM2 MixPad requires compatible Apple hardware for proper operation.
- iPhone and iPad devices require at least an A17 processor
- Mac devices require at least an Apple Silicon M1 processor
Performance may vary depending on hardware configuration, available memory, connected audio devices, and project complexity.
6. Third-Party Hardware Support
DM2 MixPad may support certain third-party hardware devices, including legacy MIDI and DJ controllers such as the Mixman DM2.
Compatibility with third-party hardware is provided on an "as available" basis and may vary depending on operating system version, drivers, adapters, or device condition.
DM2 MixPad is not affiliated with or endorsed by the manufacturers of third-party hardware unless explicitly stated.
7. Updates and Modifications
We may release updates, bug fixes, improvements, or new features for DM2 MixPad at any time without prior notice.
Some features may change, be modified, or be removed as part of future updates.
8. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DM2 MixPad DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- UNINTERRUPTED OR ERROR-FREE OPERATION
We do not guarantee that the Software will operate without interruptions, latency, compatibility issues, or data loss.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DM2 MixPad SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SOFTWARE.
THIS INCLUDES, BUT IS NOT LIMITED TO:
- LOSS OF DATA
- LOSS OF PROFITS
- BUSINESS INTERRUPTION
- AUDIO PROJECT CORRUPTION
- HARDWARE OR SOFTWARE COMPATIBILITY ISSUES
IN NO EVENT SHALL DM2 MixPad'S TOTAL LIABILITY EXCEED THE AMOUNT PAID FOR THE SOFTWARE, IF ANY.
10. Termination
This Agreement remains effective until terminated.
Your rights under this Agreement will terminate automatically if you fail to comply with any of its terms.
Upon termination, you must stop using the Software and remove all copies from your devices.
11. Privacy
DM2 MixPad may collect limited technical or diagnostic information necessary for application functionality, troubleshooting, analytics, or crash reporting.
Any data collection practices will be described separately in the DM2 MixPad Privacy Policy.
12. Apple App Store Terms
If DM2 MixPad is downloaded through Apple's App Store, you acknowledge that:
- Apple is not responsible for the Software or its support
- Apple has no obligation to provide maintenance or support services
- Apple is a third-party beneficiary of this Agreement
- Your use of the Software must comply with applicable App Store terms
13. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the jurisdiction in which the Software provider operates, without regard to conflict of law principles.
